We only collect, store and process the personal data that you explicitly provide to us or that is generated in the context of your use of our services. We request and receive your personal data when you subscribe for our newsletter, when you create an account and use our SaaS platform, and when you contact our team.
In addition, we collect personal data through automated technical means, such as cookies, log files and similar technologies when you visit our website or use our platform, as further described in the cookie section below.
We may also process personal data contained in correspondence and communications with you, for example by email, telephone or via contact forms on our website. Where appropriate, we can obtain personal data from third-party sources, such as public registers, business platforms or referrals from our clients or partners. Finally, we may collect personal data when you participate in our events, webinars or other (online) activities organised by Falcker Innovations B.V.
Which personal data does Falcker Innovations B.V. process?
Personal data includes all information about an identified or identifiable natural person. Falcker Innovations B.V. processes the following personal data, depending on the relation and the purpose:
- Our (future, current and old) clients and their (lawful) representatives, staff and contact persons.

- (business) contact details (such as email address and telephone number); date and place of birth; title and position;
- (business) financial details, including invoice and payment details; information obtained from the Chamber of Commerce or other public registers;
- personal data processed in the context of delivering our SaaS products and services, as contained in agreements, support tickets and other correspondence; account and login credentials (such as username and email address);
- usage data and technical logs generated through the use of our SaaS platform.

Why does Falcker Innovations B.V. process personal data?
Falcker Innovations B.V. processes personal data because it is necessary for the performance of a contract including for the following purposes:
- entering into and executing agreements with clients and business relations; delivering and maintaining our SaaS products and services, including onboarding of new clients and users, implementing product updates and new features, and providing technical support;
- processing orders and handling invoicing and payments;
- managing client accounts and user access to our platform, including the creation, administration and (de)activation of user profiles and access rights;
- maintaining contact with clients and their representatives, for example to answer questions, handle requests and manage the commercial relationship; and
- processing job applications and carrying out the recruitment and selection process.
Falcker Innovations B.V. processes personal data because it is necessary to comply with legal obligations, including but not limited to:
- Complying with tax and accounting obligations, including retention obligations under Dutch tax law (Belastingwet) and the Dutch Civil Code (Burgerlijk Wetboek);
- fulfilling reporting obligations to competent authorities under applicable Dutch and EU legislation, including the GDPR and the Dutch Implementation Act of the GDPR;
- responding to lawful requests from public authorities, courts or supervisory authorities; and complying with any other statutory obligations applicable to Falcker Innovations B.V. as a SaaS provider.
Falcker Innovations B.V. processes personal data on the basis of its legitimate interests in the context of its general business operations and services, including for the following purposes:
- To provide and improve our SaaS products and services, including analysing usage behaviour and platform performance to optimise functionality and user experience; to maintain and develop our business relationships and commercial network;
- for quality control, internal audits and complaint handling; to establish, exercise or defend the legal position and rights of Falcker Innovations B.V.;
- to send relevant product updates, newsletters or event invitations to existing clients and contacts, taking into account their communication preferences; to secure and monitor our IT systems, network infrastructure and platform against unauthorised access, fraud or misuse;
- to carry out general business operations including financial administration, business planning and internal reporting; and
- to improve our website and tailor our offering to the needs and preferences of our users.
Falcker Innovations B.V. processes personal data on the basis of your consent for the following purposes:
- Sending digital newsletters, product updates, invitations or other marketing communications, taking into account the communication preferences specified by you;
- storing the personal data of job applicants beyond the standard retention period for potential future vacancies, where the applicant has given explicit consent to this effect, and
- the placement of certain cookies when you visit our website.
You may withdraw your consent at any time by contacting us at info@falcker.com or by using the unsubscribe option in our communications. Withdrawal of consent does not affect the lawfulness of processing carried out prior to such withdrawal.
Automated decision-making and profiling
Falcker Innovations B.V. does not make decisions based solely on automated processing, including profiling, which produce legal effects or similarly significantly affect you, as referred to in Article 22 GDPR. No automated decision-making or profiling is applied in our data processing activities.
How long do we keep personal data?
Falcker Innovations B.V. does not store your personal data longer than is strictly necessary to achieve the purposes for which your data is collected. We apply the following retention periods:
- Client and contract data: 7 years after the end of the contract, in accordance with Dutch tax and accounting law (Belastingwet/Burgerlijk Wetboek);
- Applicant data: up to 4 weeks after the end of the recruitment process, unless the applicant has consented to a longer retention period (up to 1 year) for future vacancies;
- Data of other business relations: up to 2 years after the last contact;
- Website visitor data (including cookies and IP addresses): in accordance with the applicable cookie retention periods as set out in the cookie section below.
Only when we are legally obliged or when this is necessary to protect our interests in the context of legal proceeding, do we retain your personal data for a longer period than mentioned above.
Sharing personal data with third parties
Falcker Innovations B.V. shares personal data with third parties if this is necessary for the execution of our agreement with you or to comply with a legal obligation.
Falcker Innovations can also, within the framework of its further business operations, share personal data with external suppliers, such as IT suppliers, communication service providers, or other suppliers to whom Falcker Innovations B.V. outsources certain (supporting) services. A data processing agreement is concluded with any third party that processes personal data on behalf of and on the instructions of Falcker Innovations B.V. in its capacity as processor, in which it is set out how the processor must handle the personal data and which security measures must be observed.
In this respect, we may share personal data with the following categories of third parties:
- IT and cloud infrastructure providers (such as hosting, storage and SaaS platform services);
- Payment processors and financial service providers;
- Communication and collaboration tool providers (such as email and video conferencing services);
- HR and recruitment software providers;
- Marketing and analytics service providers;
- Leadinfo B.V., Rotterdam, the Netherlands (for lead generation purposes, as further described in the cookie section below);
- Professional advisers such as accountants, auditors and legal counsel;
- Potential investors, purchasers or trustees in the context of a sale, (de)merger or split of our business in full or in part.
- Where required under the GDPR, a data processing agreement is concluded with each of the above parties that process personal data on behalf of Falcker Innovations B.V.
Falcker Innovations B.V. processes personal data primarily within the European Economic Area (EEA). In some cases, personal data may be transferred to or processed by third parties located outside the EEA (such as cloud service providers or software vendors). In those cases, Falcker Innovations B.V. ensures that such transfers take place on the basis of an adequacy decision by the European Commission, or on the basis of appropriate safeguards such as Standard Contractual Clauses (SCCs) as referred to in Article 46 GDPR. Cookies, or similar techniques we use
Falcker Innovations B.V. primarily uses technical and functional cookies. Falcker Innovations B.V. also uses analytical cookies that do not infringe on your privacy. A cookie is a small text file that is stored on your computer, tablet, or smartphone when you first visit this website. The cookies we use are necessary for the technical operation of the website and your ease of use. They ensure that the website works properly and, for example, remember your preferred settings. We can also optimize our website with this. You can opt out of cookies by setting your internet browser so that it no longer stores cookies. In addition, you can also delete all information previously stored via the settings of your browser.
Leadinfo
We use the lead generation service provided by Leadinfo B.V., Rotterdam, The Netherlands, which recognizes visits of companies to our website based on IP addresses and shows us related publicly available information, such as company names or addresses. In addition, Leadinfo places two first-party cookies for providing transparency on how our visitors use our website and the tool processes domains from provided form inputs (e.g. “leadinfo.com”) to correlate IP addresses with companies and to enhance its services. Your rights
Under the GDPR, you have the following privacy rights:
- Right of access: you can request access to the personal data that Falcker Innovations B.V. has collected about you.
- Right to rectification, addition, erasure or restriction: you may request that your personal data be corrected, supplemented, deleted or that processing be restricted.
- Right to object: you have the right to object to the processing of your personal data or to request restriction of such processing, in particular where processing is based on legitimate interests.
- Right to data portability: you have the right to receive your personal data in a structured, commonly used and machine-readable format, and to transfer that data to another controller.
- Right to be forgotten: you have the right to request the deletion of your personal data where there is no longer a legitimate ground for retaining it.
- Right to withdraw consent: where processing is based on your consent, you may withdraw that consent at any time, without affecting the lawfulness of processing carried out prior to such withdrawal.
- Right to lodge a complaint: you have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
Please note that these rights are not absolute and may only apply under certain conditions. Circumstances may arise in which Falcker Innovations B.V. is authorised not to comply fully with your request, such as where compliance would conflict with a legal obligation or the legitimate interests of Falcker Innovations B.V. or third parties. We will inform you in such cases.
